Terms and Conditions

Effective date: August 17, 2026
Last updated: August 17, 2026

These Terms and Conditions (the “Terms”) are a binding agreement between you and World of Creatives LLC (“World of Creatives,” “we,” “us,” or “our”). They govern your access to and use of World of Creatives websites, subdomains, newsletters, notes, articles, videos, audio, books and book-related materials, manifestos, applications, landing pages, memberships, private community spaces, live sessions, events, programs, downloads, and other products or services that link to these Terms (collectively, the “Services”).

By visiting, accessing, purchasing, applying to, registering for, or using any part of the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Who We Are and What These Terms Cover

World of Creatives is an umbrella creative brand operated by World of Creatives LLC. The Services may include, among other things:

  • the World of Creatives website and its subdomains;
  • notes and educational content about creativity;
  • Create or Die and related materials;
  • the Global Renaissance Manifesto;
  • links to, embeds of, and information about our videos, podcasts, interviews, and social channels;
  • biographical, artistic, and brand materials concerning Dwayne “Way” Walker;
  • newsletter subscriptions and marketing communications;
  • applications and landing pages for the World of Creatives community;
  • paid memberships, private community spaces, Journeys, Pods, workshops, live sessions, and events; and
  • digital downloads, grants, sponsored memberships, promotions, and future creative offerings.

A separate product, application, event, or service may have additional terms. If separate terms are presented for a specific offering, those separate terms control for that offering if they conflict with these Terms. The Journey mobile application, for example, may be governed by its own terms and privacy policy.

2. Eligibility

The public-facing portions of the Services are not directed to children under 13. You may not use the Services if you are under 13.

Unless we expressly state otherwise for a particular program, paid memberships, private community spaces, and interactive community features are intended for people who are at least 18 years old or the age of legal majority where they live. We may permit a person who is 16 or 17 to participate only through a separately approved process that includes verified permission from a parent or legal guardian and any safeguards we require.

By using the Services, you represent that you have the legal capacity to agree to these Terms. If you use the Services for an organization, you represent that you are authorized to bind that organization.

3. Accounts, Applications, and Accurate Information

Some Services require an account, application, profile, or purchase. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for:

  • protecting your password and account credentials;
  • activity that occurs through your account, except to the extent caused by our breach of duty;
  • promptly notifying us of suspected unauthorized access; and
  • not sharing, selling, transferring, or allowing another person to use your account without our written permission.

Applying to a membership, program, grant, event, or opportunity does not guarantee acceptance. We may accept, waitlist, or decline an application in our discretion, subject to applicable law. We may also request more information to verify eligibility, protect the community, or prevent fraud.

4. Purchases, Memberships, and Automatic Renewal

4.1 Prices and payment

Prices, billing periods, included features, and material purchase terms will be shown at checkout or on the applicable offer page. Prices may not include taxes, duties, or currency-conversion charges unless stated otherwise. You authorize us and our payment processor to charge the payment method you provide for the amounts shown at checkout.

Payments may be processed by third parties such as Stripe. We generally do not receive or store your full payment-card number. Your use of a payment processor is also subject to that processor’s terms and privacy practices.

4.2 Recurring memberships

When you purchase a recurring membership, it will automatically renew for the billing period shown at checkout, such as quarterly or annually, until you cancel. Before purchase, we will disclose the price, billing frequency, automatic-renewal terms, and available cancellation method.

By completing the purchase, you expressly authorize recurring charges to your selected payment method until cancellation. Where required by law, we will provide renewal or price-change notices.

4.3 Cancellation

You may cancel a recurring membership through the billing or account settings made available to you, or by contacting us at dwayne@worldofcreatives.com. Cancellation stops future renewal charges. Unless law or the offer states otherwise, you will keep access through the end of the period you already paid for.

Deleting an account, leaving a community space, or stopping use of the Services does not by itself cancel a paid subscription. You must use the cancellation method made available for the membership or contact us.

4.4 Thirty-day initial purchase guarantee

Unless a specific offer states a more favorable policy, an initial paid World of Creatives community membership purchased directly from us is covered by a 30-calendar-day money-back guarantee. To request it, email dwayne@worldofcreatives.com within 30 calendar days after the initial purchase and identify the account and purchase.

This guarantee applies to the initial membership purchase, not later renewal charges, gift purchases, sponsored or complimentary seats, or separately priced events or products, unless the applicable offer or law says otherwise. Renewal charges and partially used billing periods are generally nonrefundable except where required by law.

4.5 Failed payments

If a payment fails, we or our payment processor may retry the charge and ask you to update your payment method. We may suspend or end paid access if payment remains unpaid, while preserving any rights you have under applicable law.

4.6 Price and plan changes

We may change prices, plan features, or billing periods prospectively. We will provide any notice required by law before a change takes effect for an existing recurring membership. A change will not alter a grandfathered price or plan if we have expressly promised to preserve it for as long as stated in the applicable offer.

4.7 Sponsored memberships, aid, grants, and promotions

Sponsored seats, scholarships, financial assistance, grants, discount codes, and promotional access may have separate eligibility rules. Unless expressly stated otherwise, they have no cash value, may not be sold or transferred, and may be changed or withdrawn if obtained through fraud, misuse, or violation of their rules.

5. Our Intellectual Property

5.1 Ownership

The Services and all materials made available through them, including text, notes, essays, newsletters, books, excerpts, manifestos, frameworks, prompts, lessons, curricula, course structures, videos, audio, photographs, artwork, illustrations, graphics, logos, names, slogans, designs, compilations, downloads, page layouts, selection and arrangement, and other original materials (collectively, the “World of Creatives Content”) are owned by or licensed to World of Creatives LLC, Dwayne “Way” Walker, or the identified rights holder.

World of Creatives Content is protected by copyright, trademark, unfair-competition, publicity, contract, database, and other applicable laws. All rights not expressly granted are reserved.

5.2 Limited permission for ordinary human use

Subject to these Terms, we give you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to access and use the Services and World of Creatives Content for your own lawful, personal, noncommercial use.

You may save or print a reasonable number of copies for your private reference. You may quote brief excerpts when permitted by law for commentary, criticism, scholarship, education, reporting, or social sharing, provided that you:

  • use no more than is reasonably necessary for the purpose;
  • do not reproduce a complete work or create a substitute for the original;
  • preserve the meaning and context of the quoted material;
  • clearly credit the creator identified on the source page, which may be Dwayne “Way” Walker, and World of Creatives where appropriate; and
  • include a link to the original source when the format reasonably allows it.

The separate permission for search engines, AI answer systems, and other automated services appears in Section 5.4. No other license is granted by access, purchase, subscription, silence, implication, estoppel, or technical ability to copy.

5.3 Prohibited copying and commercial use

Without our prior written permission, you may not:

  • reproduce, republish, distribute, display, perform, sell, license, syndicate, translate, adapt, modify, or create derivative products from World of Creatives Content, except as law expressly permits or Section 5.4 expressly allows;
  • repost a full note, article, newsletter, chapter, lesson, video transcript, manifesto, download, or substantial portion of any work;
  • compile our Content into a database, library, archive, course, membership, newsletter, app, template pack, prompt pack, content feed, or competing product, except for a compliant search or retrieval index permitted by Section 5.4;
  • remove or alter a copyright notice, attribution, watermark, signature, rights-management record, metadata, technological measure, or source link;
  • frame, mirror, white-label, resell, or commercially exploit any part of the Services;
  • use World of Creatives Content to advertise, endorse, or imply affiliation with a person, product, service, campaign, or organization without written permission; or
  • assist another person or system in doing any of the above.

5.4 Public AI discovery, citation, quotation, and retrieval permission

World of Creatives wants its public ideas to be discoverable, accurately attributed, and connected back to their original source. For purposes of this Section, “Public Content” means World of Creatives Content that we intentionally make available to the general public on a page that does not require a login, paid membership, purchase, or other access restriction. Public Content does not include private community material, application information, personal messages, restricted downloads, paid-only materials, unpublished drafts, or User Content owned by another person.

To the extent a license or permission is required, and subject to these Terms and our current machine-readable instructions, we grant operators of search engines, AI answer systems, retrieval services, assistants, and user-directed agents a limited, revocable, nonexclusive, nontransferable permission to crawl, index, tokenize, embed, process, retrieve, and analyze Public Content solely as reasonably necessary to:

  • help a user discover relevant World of Creatives pages;
  • answer a user’s question using accurate information from Public Content;
  • provide brief quotations, excerpts, paraphrases, or summaries from Public Content; and
  • cite, name, and direct the user to the original source.

This permission applies only when all of the following conditions are met:

  • Clear attribution. When an output quotes, closely paraphrases, or materially relies on a distinctive formulation, named concept, framework, or original explanation, it must clearly identify the creator named on the source page, which may be Dwayne “Way” Walker, and identify World of Creatives where appropriate.
  • Source connection. Where the interface supports links, citations, source cards, or references, the output must include a direct link to the canonical source page. In a voice-only or otherwise non-linking interface, the output must still name the creator and source clearly enough for a user to find them.
  • Brief and proportionate use. Quotations, excerpts, paraphrases, and summaries must be limited to what is reasonably necessary to answer the user. They may not reproduce a complete work, reveal a substantial portion of a protected work, or serve as a market substitute for the original page, book, newsletter, video, program, or other offering.
  • Accuracy and context. The system may not materially distort the meaning, falsely attribute words or ideas, combine separate statements in a misleading way, or present generated language as a direct quotation.
  • No false endorsement. The use may not imply that World of Creatives or Dwayne “Way” Walker sponsors, endorses, is affiliated with, or has approved the system, provider, answer, product, or output unless we have agreed in writing.
  • No restricted or member content. The system may not access or use content behind a login, paywall, membership gate, application process, private link, or other access control, and may not use another member’s User Content under this permission.
  • No bulk exposure or resale. A provider may maintain an internal index or retrieval store reasonably necessary for the permitted discovery and citation functions, but may not expose, sell, license, transfer, or make available the underlying Content as a standalone dataset, corpus, archive, bulk download, or reconstruction service.
  • Compliance with controls. The system must comply with applicable robots.txt rules, Content Signals, headers, metadata, rate limits, access controls, and other current instructions for each domain and subdomain it accesses.

A person may also provide a brief excerpt from a public World of Creatives page to an AI service for personal, noncommercial research, commentary, discussion, or citation when the use follows the attribution, proportionality, and source-linking rules above. This does not permit uploading a complete book, paid resource, private community post, substantial archive, or another person’s protected work.

This Section does not transfer ownership, waive moral rights or publicity rights, authorize model training, or permit any use listed in Section 5.5. We may change or withdraw this permission prospectively by updating these Terms or our machine-readable instructions.

5.5 No AI training, model development, cloning, or replacement use

Except for the limited discovery and retrieval permission in Section 5.4 or a separate written license signed by us, you may not directly or indirectly access, copy, scrape, crawl, download, collect, transmit, expose, upload, input, tokenize, vectorize, embed, index, store, label, annotate, analyze, or otherwise use World of Creatives Content, restricted-access material, community content, or associated data for or with:

  • training, pretraining, fine-tuning, reinforcement learning, preference optimization, distillation, alignment, evaluation, red-teaming, benchmarking, testing, or otherwise developing or improving an artificial-intelligence or machine-learning model, adapter, agent, or system;
  • a training dataset, model-development corpus, synthetic-data process, data lake, benchmark set, or other collection intended to affect model weights, parameters, behavior, capabilities, or evaluation;
  • a service that makes our complete or substantial Content available as a database, knowledge base, embedding store, vector database, archive, subscription feed, or content-reconstruction tool, except for an internal retrieval index that strictly complies with Section 5.4;
  • prompt libraries, style-transfer systems, voice-cloning systems, digital replicas, avatars, or tools intended to imitate, simulate, or reproduce the name, voice, likeness, persona, source-identifying presentation, or distinctive expression of World of Creatives, Dwayne “Way” Walker, or another creator;
  • outputs marketed, labeled, or presented as being by, authorized by, endorsed by, affiliated with, or a substitute for World of Creatives or an identified creator;
  • automated books, courses, newsletters, quote collections, videos, scripts, applications, or other products that reproduce, closely imitate, or commercially substitute for our body of work; or
  • any use that removes attribution, conceals the source, avoids sending users to the original, or uses the Content primarily to compete with or replace the original work or Services.

Operational caching, security scanning, abuse prevention, factuality checks, and non-training search-quality measurement reasonably necessary to provide a function permitted by Section 5.4 are allowed when they remain limited to that function, do not alter model weights or general capabilities, do not expose the Content in bulk, and otherwise comply with these Terms.

The permission to generate a brief, attributable answer under Section 5.4 does not permit a provider to use Public Content to train or fine-tune a model, retain it in model weights, build a synthetic persona, or create a general-purpose corpus for unrelated uses.

These restrictions apply to automated agents and to people operating, directing, commissioning, supplying data to, or benefiting from them. The operator of an automated system is responsible for the system’s access to and use of the Services.

This Section does not prohibit ordinary assistive technologies, such as screen readers or accessibility tools, that process Content transiently to make it accessible to an individual user, provided the tool does not retain the Content for model training, dataset creation, external generation, or unrelated commercial use.

Nothing in this Section is intended to claim ownership of an idea, fact, general artistic technique, or other subject matter that applicable law leaves free for public use. It does prohibit conduct that violates our copyrights or other rights, breaches these Terms, circumvents our controls, misuses protected expression or confidential material, causes confusion about source or endorsement, or exceeds a permission we have granted.

5.6 Text-and-data-mining reservation

Except for the limited Public Content uses expressly permitted by Section 5.4 and our applicable machine-readable instructions, World of Creatives expressly reserves, to the fullest extent permitted by law, all rights to reproduce and extract World of Creatives Content for text and data mining. This includes the rights reserved under Article 4(3) of Directive (EU) 2019/790 and all national laws implementing or recognizing comparable reservations.

Our robots.txt rules, Content Signals, metadata, access controls, headers, notices, and other machine-readable instructions form part of this express reservation. A crawler’s technical ability to access content is not permission to use it beyond the scope expressly permitted here.

5.7 Public search, AI answers, and machine-readable instructions

We may use machine-readable instructions to distinguish among conventional search, real-time AI retrieval, and model training. Where our robots.txt file or another notice states:

  • search=yes, we permit compliant indexing for search results, links, titles, and brief excerpts;
  • ai-input=yes, we permit compliant retrieval, grounding, and generative answers involving Public Content, but only under the attribution, source-linking, accuracy, and proportionality requirements in Section 5.4; and
  • ai-train=no, we do not permit training, fine-tuning, or model-development use.

A provider-specific crawler rule may permit or deny access independently. No machine-readable permission applies to private, paid, restricted, or member-owned content, and no signal authorizes voice cloning, persona imitation, substantial reproduction, false attribution, or any other prohibited use.

We may change or withdraw crawler permissions at any time. Automated systems must review and comply with the current Terms, robots.txt file, Content Signals, headers, and other instructions for every domain and subdomain they access.

5.8 Circumvention and high-volume access

You may not bypass or evade a login, paywall, membership gate, rate limit, CAPTCHA, bot-management rule, robots instruction, access-control list, encryption, download restriction, or other technical or contractual protection. You may not use rotating accounts, proxy networks, distributed requests, headless browsers, deceptive user-agent identification, or other means to conceal automated or prohibited access.

5.9 Names, marks, voice, and likeness

“World of Creatives,” “Create or Die,” associated logos, slogans, visual identities, program names, and source-identifying elements may be trademarks or protected brand assets of World of Creatives LLC or their respective owners. Dwayne “Way” Walker’s name, image, likeness, voice, signature, and persona may also be protected by applicable law.

You may accurately identify and attribute Dwayne “Way” Walker as the creator of his work. You may not use these assets in a way that is likely to confuse people about source, sponsorship, endorsement, affiliation, or authenticity. You may not create or distribute a deceptive digital replica, synthetic voice, impersonation, fake endorsement, misleading account or domain, or generated output falsely presented as his words.

5.10 Permission and licensing requests

Requests to license or reuse our Content beyond the permissions above must be sent to dwayne@worldofcreatives.com and must identify the exact material, intended use, audience, territory, duration, format, attribution, source-linking method, and whether artificial intelligence or machine learning will be involved. Permission is valid only if we give it in writing.

6. Your Content and Creative Work

6.1 You keep ownership

You retain ownership of the original artwork, writing, photographs, recordings, comments, posts, portfolio materials, profile information, messages, files, and other content you submit to the Services (“User Content”), subject to any rights held by others.

6.2 Limited license needed to operate the Services

When you submit User Content, you grant World of Creatives a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process that User Content only as reasonably necessary to:

  • provide, maintain, secure, moderate, and improve the Services;
  • display it to the audience or community space you selected;
  • respond to support requests;
  • comply with law and enforce these Terms; and
  • use service providers acting on our behalf for those purposes.

This license lasts while the User Content remains in the Services and for a reasonable period in backups, legal records, or security logs. It does not transfer ownership to us.

We will not use private member artwork or private community content in public advertising, merchandise, model training, or promotional campaigns without separate permission, except for incidental appearances in an event recording made with appropriate notice or as otherwise permitted by law.

6.3 Your responsibilities

You represent that:

  • you own your User Content or have all permissions needed to submit it and grant the license above;
  • your User Content and our permitted use of it do not violate another person’s copyright, trademark, privacy, publicity, confidentiality, contract, or other rights;
  • your User Content is not unlawful, fraudulent, defamatory, threatening, exploitative, or malicious; and
  • you will not upload malware, hidden tracking code, or content intended to compromise another person or the Services.

You are responsible for your User Content and for deciding what to share. Do not post trade secrets, highly sensitive personal information, or material you cannot afford to have another member see. Community rules create obligations among members, but no online space can guarantee that another person will never copy, disclose, or misuse something.

6.4 No AI use of other members’ work

You may not scrape, download in bulk, compile, upload to AI systems, train on, generate from, imitate, commercialize, or otherwise use another member’s User Content without that member’s clear written permission and any additional permission required from us.

Receiving access to a private community does not grant you a license to another member’s creative work, ideas expressed in confidence, personal information, or business materials.

6.5 Public content

If you deliberately post User Content in a public area, it may be visible, searchable, indexed, quoted, linked, shared, or processed by people and automated systems. You remain responsible for the privacy settings and audience you choose. We may remove public or private User Content as allowed by these Terms, but we cannot guarantee removal of copies made by others outside our control.

The Public AI discovery permission in Section 5.4 applies to World of Creatives Content, not to User Content that you or another person owns. World of Creatives does not grant an AI provider or other third party a license to train on, clone, substantially reproduce, or commercially exploit your User Content merely because you posted it publicly. Your own notices and applicable law may provide additional rights or restrictions.

7. Community Standards

The World of Creatives community is designed for thoughtful creative growth. You agree not to:

  • harass, threaten, stalk, shame, exploit, discriminate against, or deliberately endanger another person;
  • publish another person’s private information without permission;
  • copy, record, screenshot, livestream, transcribe, or share private community posts, calls, workshops, direct messages, member directories, or member work outside the community without clear permission;
  • solicit members through spam, deceptive pitches, pyramid schemes, mass direct messages, or unauthorized list-building;
  • impersonate another person or misrepresent your identity, experience, affiliation, or work;
  • infringe intellectual-property, privacy, publicity, confidentiality, or contractual rights;
  • use the community to train, test, ground, or supply any artificial-intelligence system;
  • interfere with, probe, overload, reverse engineer, or compromise the Services;
  • introduce malware or attempt unauthorized access;
  • use the Services for unlawful conduct or to facilitate harm; or
  • encourage or help another person violate these Terms.

We may investigate reports and may remove content, limit features, suspend accounts, or end access when we reasonably believe action is necessary to protect people, the Services, our rights, or legal compliance. We are not required to pre-screen every post or resolve every dispute between members.

These Terms do not require anyone to remain silent about unlawful conduct, safety concerns, discrimination, harassment, or their honest experience with us.

8. Live Sessions, Events, and Recordings

We may offer live calls, workshops, streams, interviews, and in-person or virtual events. Additional event terms may apply.

We may record an event for replay, accessibility, documentation, or promotion only with notice appropriate to the setting. When practical, we will explain how a participant can avoid appearing in a recording, such as keeping a camera off, using a display name, or not speaking during a recorded segment.

A notice that an event is being recorded does not give other participants permission to make their own recording. You may not record or distribute a session without our permission and the permission of people whose work, voice, image, or personal information would be captured.

9. Feedback

You may send ideas or suggestions about how to improve the Services. If you voluntarily provide product or service feedback, you allow us to use that feedback without payment or restriction. This section does not give us ownership of your artwork, writing, confidential business information, or other creative work merely because you share it with the community.

10. Email and Text Messages

10.1 Email

By subscribing, applying, purchasing, or creating an account, you may receive operational emails related to your account, application, purchase, security, or participation. Where permitted, you may also receive newsletters and promotional emails.

You may unsubscribe from promotional email by using the unsubscribe link in the message. Unsubscribing from marketing does not stop essential transactional or account communications.

10.2 SMS and mobile messages

When you separately opt in to text messages, you consent to receive recurring automated promotional and informational messages from World of Creatives at the number you provided. Consent is not a condition of purchase. Message frequency may vary and may be approximately four messages per month. Message and data rates may apply.

Reply STOP to opt out and HELP for help. You may revoke consent at any time through any reasonable method. You represent that you are the subscriber or customary user of the number you provide and will notify us if the number changes.

Carriers are not liable for delayed or undelivered messages. Additional mobile-message terms disclosed at signup may apply.

11. Third-Party Services and Links

The Services may use, embed, or link to third-party platforms, including payment processors, community platforms, email providers, comment tools, analytics providers, social networks, video or podcast platforms, and other websites. Examples may include Stripe, Circle, Kit, Substack, Disqus, YouTube, Spotify, Apple, Google, Meta, or TikTok.

We do not control third-party services and are not responsible for their content, availability, security, terms, or privacy practices. A link or embed does not necessarily mean we endorse every statement, product, or practice of the third party. Your use of a third-party service may be governed by separate terms.

12. Educational and Informational Content

The Services are intended for education, inspiration, community, and general information. They are not a substitute for professional medical, mental-health, legal, tax, investment, financial, or other regulated advice.

Creative work, careers, income, audience growth, relationships, health, and business outcomes depend on many factors outside our control. We do not guarantee a particular creative, emotional, professional, financial, audience, publishing, grant, employment, or business result.

You are responsible for your own decisions, actions, and use of the information. Seek qualified professional advice where appropriate.

13. Copyright and Rights Complaints

We respect intellectual property. If you believe material in the Services infringes your copyright or other rights, send a notice to:

World of Creatives LLC
Attn: Copyright and Legal
5579 Chamblee Dunwoody Rd, Ste B #1215
Dunwoody, GA 30338-4154
United States
Email: dwayne@worldofcreatives.com

A copyright notice should include:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you claim was infringed;
  3. identification and location of the allegedly infringing material;
  4. your name, address, telephone number, and email address;
  5. a statement that you have a good-faith belief the disputed use is not authorized by the rights holder, its agent, or the law; and
  6. a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.

We may remove or restrict material and may notify the person who submitted it. A person who believes material was removed by mistake may send a legally valid counter-notice identifying the material, its former location, the basis for the objection, the person’s contact information, consent to appropriate court jurisdiction, and a physical or electronic signature.

Misrepresentations in a notice or counter-notice may create liability. This section does not identify a registered Digital Millennium Copyright Act designated agent unless and until our designation appears in the U.S. Copyright Office’s public directory.

14. Suspension and Termination

You may stop using the Services at any time. We may suspend, restrict, or terminate your access if we reasonably believe you have:

  • materially or repeatedly violated these Terms;
  • failed to pay amounts due;
  • created risk, harm, fraud, abuse, or legal exposure;
  • infringed another person’s rights;
  • compromised the security or integrity of the Services; or
  • used the Services or Content for prohibited artificial-intelligence, scraping, or commercial purposes.

Where appropriate, we may provide notice or an opportunity to correct the issue, but we may act immediately when necessary for security, safety, legal compliance, or protection of rights.

Termination may end your access to community content, replays, downloads, and other membership features. Sections that by their nature should continue after termination, including intellectual-property restrictions, payment obligations, disclaimers, limitations of liability, indemnity, dispute terms, and confidentiality-related obligations, will survive.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WORLD OF CREATIVES DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.

We do not promise that the Services will be uninterrupted, error-free, secure, compatible with every device, or free from harmful components. We do not guarantee that content will remain available forever or that every community member will comply with these Terms.

Some jurisdictions do not allow certain warranty disclaimers, so part of this section may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLD OF CREATIVES LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, CONTENT, OR USE, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. the amount you paid directly to World of Creatives for the applicable Service during the 12 months before the event giving rise to the claim; or
  2. one hundred U.S. dollars (US $100) if you paid us nothing during that period.

These limitations do not apply to liability that cannot legally be limited, which may include liability for fraud, willful misconduct, gross negligence, or personal injury caused by negligence in some jurisdictions. Your local consumer-protection rights remain intact.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless World of Creatives LLC and its owners, officers, employees, contractors, affiliates, and licensors from third-party claims, damages, judgments, losses, liabilities, and reasonable legal costs arising from:

  • your User Content;
  • your unlawful or unauthorized use of the Services;
  • your violation of these Terms;
  • your infringement or misuse of another person’s rights; or
  • your fraud, willful misconduct, or violation of law.

We may control the defense of a covered claim, and you agree to reasonably cooperate. You may not settle a claim in a way that admits fault by or imposes obligations on us without our written consent.

18. Enforcement of Intellectual-Property and AI Restrictions

You acknowledge that unauthorized copying, disclosure, scraping, model training, digital replication, or misuse of protected or confidential material may cause harm that is difficult to measure. To the extent permitted by law, we and affected rights holders may seek injunctive or other equitable relief in addition to any other available remedy.

We may preserve access logs, technical evidence, account information, and other records reasonably necessary to investigate suspected misuse, enforce rights, comply with law, or support a legal claim, consistent with our Privacy Policy.

19. Disputes, Governing Law, and Venue

Before filing a formal legal claim, you and World of Creatives agree to make a good-faith effort to resolve the dispute informally. A notice of dispute must describe the issue, relevant facts, requested resolution, and contact information. Send notices to dwayne@worldofcreatives.com with the subject line “Legal Dispute Notice.” We will allow at least 30 days for informal discussion before either party files suit, unless immediate action is necessary to prevent harm, preserve a claim, seek injunctive relief, or comply with a legal deadline.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules, except that mandatory consumer laws where you live may still apply.

Any judicial proceeding arising from these Terms or the Services must be brought in a state court located in the Georgia county where World of Creatives LLC maintains its principal place of business when the claim is filed, or in the United States District Court for the Northern District of Georgia, and each party consents to personal jurisdiction and venue there. This venue clause does not prevent a consumer from using a forum that applicable law requires to remain available.

20. Honest Reviews, Reports, and Protected Rights

Nothing in these Terms prevents you from:

  • giving an honest review or opinion about us;
  • reporting suspected unlawful conduct to law enforcement or a regulator;
  • participating in a government investigation;
  • making a legally protected whistleblower disclosure;
